If someone is an undischarged bankrupt........?


...are they allowed to do self-employed work? This person was made bankrupt 2 years ago for 拢15k, not connected to business at all, personal debt through the breakdown of a relationship. He knows he cannot be a company director or open a business as such, but could he legally work on his own as a maintenance person or similar if it was all done properly?

Yes if it is all above board and he is not working for cash in hand and not declaring it.

I *THINK* he or she could be a sole trader without problems. However, sole traders can't limit their liability. If he works as a sole trader, and blows up something expensive, his customer's insurer will chase him for the cost, and seize his assets. Of course, being a bankrupt, he doesn't have many of those, so that might work.

That's why limited companies and limited liability partnerships exist. If it goes wrong, you close the shop and walk away, and anyone the company owes money to can go whistle.

It's also why they don't let bankrupts be directors. A history of defaulting on debts is taken as a sign that you'll do the same here.

But if it's 拢15k, and s/he is good at the sole-trader job, s/he could pay it back over time and get his spurs and everything back.
