Can a bank sue me for credit card debt even if they are not able to find me to serve me with papers?


I will be away on business for several months. Can a bank take me to court without being able to serve me with papers?

First, "I'm a great person" is lying, and no one could ever arrest you for credit card debt -- it's a civil issue not a criminal issue.

But yes it's possible, there are people who never received a summons who have been sued and lost default judgments. But most people delinquent on credit card debt never get sued. There are a lot of important variables to consider, such as the amount you owe, and the state you live in, and whether you've passed the statute of limitations.

They WILL find you.....no doubt about it...sooner or later....so get ready to pay them. You could try one of those credit companies that claim they will help you pay off your credit debts.

No, but they CAN put a warrant out for your arrest for avoiding debt. I'd advise against it.

Sure they can. You signed the credit agreement and they will attempt to serve you at your last known address. They will make a reasonable effort to contact you and if they cannot find you they can sue you while showing the court that they made a reasonable effort. A potential outcome is that they will ask for a wage garnishment and seize your bank accounts (if there are any). Once they are granted a garnishment good luck in getting that resolved. You won't be able to apply for any credit in the meantime because as soon as that application hits your credit report they will have an up to date address and tada you will have papers.

The most likely outcome is they will charge off the debt as uncollectable or sell it to a debt collector who will haunt you. Charge offs are pretty horrible on your credit report so it's best to avoid them. Additionally if they charge it off you may owe taxes on that amount and the IRS WILL find you.
