Can any one help with bankruptcy? |
Ok so my friend is taking the decision to file for bankruptcy... She had good credit but then she almost went into foreclosure, her car got taken away end it up with a debt of 4 thousand dollars after the finance company sold the car in a auction. So know she's filing for bankruptcy but she says she wants to go shopping for Christmas season before she fills for that, Can she get in trouble if she buys stuff and then 3 wks later she files for bankruptcy, can she get in any kind of trouble? She won't get in trouble but she'll still have the bills. Bankruptcy does not protect her against credit abuse - racking up bills then filing bankruptcy on them. If she tries to include them, the creditor will dispute it and provide the dates she took out the credit and it will be not dischargeable. So you can probably tell your friend not to charge any more than she can repay. u can only include money that u owe 6 months before u file When she gets out of this mess advise her not to buy on impulse, live sensibly and borrow only after some risk assessment or if returns from an investment is reasonably high (and risk low) Most certainly. Any good lawyer will tell you when you file or are preparing to file to stop using credit cards immediately. This will all be looked at by a judge in a court of law! Yes she can this is fraud and the credit card companies will find out and get a judgment for any money she spends. |
