NationsBank/CHASE Just Called my Fiancee (we have no shared accts or cdt) & Told Her ALL re: MY Debt. LEGAL ?


Again, the bank and credit card issuer (who somehow pulled some 'caper' on me moments before by calling my cellphone and pretending that they were following up on a recent cadillac purchase I'd supposedly made...No such purchase made, and my cellphone number was common knowledge with the creditors, so I'm not sure what this bought them. My fiancee's name certainly never came up, nor did I offer up her phone number or any other details of my personal life). Thirty Minutes later, I returned after walking the dog to find that she'd received a call asking her to: a) Begin Making MY Payments (she - rather unwisely - gave them a payment, b) Reveal her knowldege of my finances and assests, and then Proceeded to tell her a) How I was SCREWED For Life Credit-Wise and would never find another Job, and b) MY actual CREDIT SCORE (which I don't even know) and my TOTAL DEBT LOAD across all creditors (which, again, I only have a rough estimate of). THIS CANNOT POSSIBLY BE LEGAL, CAN IT? HELP!

That's absolutely illegal. More on point than the Privacy Act is the Fair Debt Collections Act. You can find the full text of the act and the rights and remedies it affords on the Federal Trade Commission website (ftc.org).

Chances are you and/or your fiance were contacted by a collections agency, and not Chase. Try to find out who the collection agency is (by calling them back) and get their address.

Then, write both the collections agency and Chase a letter to the effect of:

On {insert date} my fiance was contacted by {name of agency} attempting to collect my debt to Chase. {Fiance's name} is not responsible for this debt, nor is she a party to this debt.

Further, your agent made representations to {fiance's name} that are private in nature, but moreover, wholly specious and without merit. It is obvious by the tenor of the phone call to {fiance's name} and the nature of the information disclosed to her that the purpose of this phone call purely harassment.

As you know, the practices outlined above clearly violate the Fair Debt Collection Practices Act. Demand is hereby made you and your agents cease and desist any further such activity. If any further attempts are made to collect my debt in a manner that violates the Fair Debt Collections Practices Act, I will be forced to take appropriate action in a court of competent jursidiction.

Further, demand is hereby made that any and all further collection attempt be made solely in writing.

Send the letter certified mail, return receipt requested. You may want to cc: your state's attorney general and the FTC.

Leaglly, They can only devulge information if she is your wife. I dont think what they did was legal, But its to late, they already have your info now......

No it is not legal. They have violated the Privacy act in so many ways it's not funny.
