Inheritence problems... please read?


I have a friend who is 21 whose parents are not alive. Her grandpa who she was raised by and later cared for has recently been put in a nurseing home and is no longer able to control his finances. My friend will inherit all of his saveings after his death. For now a uncle has taken over the finances but seems unwilling to give my friend any money for school or even for expenses she spends on her grandpa. She is struggleing to pay rent and bills. My gut tells me that her family is attempting to control this money. Does anyone have any advice for an easy way to take over the finances and invest the money in some kind of trust fund? Also should she get power of attroney for her Grandpa and how is that gone about?

Even though she's taken care of him, and set to inherit everything, the next in line or closest family member is the one who makes the decisions until the will takes effect. The only way I see is for her to get power of attorney so that she can bypass the uncle.

Sounds like her Uncle all ready has power of attorney she can check and see if he does

I think she needs a written letter signed by her grandfather and also make sure it is notarized by an attorney or some one who has the license.

one why her uncle is in the right state of mind ask him if he has her in the will? and if so take it to an attorney. if one can not be affored there are legal aid lawyers in every state find out where your are located nad see them for the power of attorney also the libary is alos a great help.

First of all, did you ever hear of spell-check?
Secondly. all of Grandpa's money should be going for HIS expenses for the nursing home and health care, medications, etc.
It is still Grandpa's money and she has absolutely no claim to it.
She should not count on inheriting anything at all. If she truly has expenses for providing for Grandpa, they she should keep the receipts and ask for reimbursement.
I highly suspect that you, as her "friend" has something to gain by "helping" her.

If no one has legal POA for finances, someone needs to be appointed by the courts since this sounds like it is going to be "messy".

Have your friend go to an attorney that she trusts and has a set of balls. I had a friend go thru this too. This type of situation always seems to bring out the greed in families.
