Bank account has been frozen due to CC debt?


I was part of a Credit counseling group, Was making payments each month,they got rid of some debt as the funds built up . Upon doing this I started receiving letters from a lawyer for MBNA saying i will be sued. They took it to court and now frozen my bank account. The lawyer wants $8300 in full in order to unfreeze my bank account ,and will start garnishing my paycheck. They say they will not unfreeze my account until its paid in full and they can hold the acct for up to one year. Obviously I can not afford to pay it in full but was willing to pay the lawyer $500 a month till the debt is relieved and to have my account opened immediatly. They stated it is too late to make payments. Upon taking the info to ignore the letters from the credit counseling company,it has now biten me. I no longer deal with the counseling company. Anyone have any ways I can take care of this matter? Is bankruptcy a good choice. My total debt is about 15000 and about 50% of my yearly income?

I went through a debt consolidation company and got screwed up as well. I don't think they can freeze your account and garnish your wages until they actually take you to court. Have you received your summons yet? If not, then you need to contact a lawyer because all that has to go through the court system first.

I don't think you have enough debt to declare bankruptcy. $15K isn't that much debt.

Your biggest mistake was not going to court. You might have been able to work out a payment plan. They have a judgment and will garnish. I think they can only take 25%.

They are playing hardball with you right now. Don't show any fear and negotiate a payment plan.

I went through the same situation where they froze my bank account. Call and negotiate a monthly payment plan. They won't unfreeze your account so cut off all automatic withdraws or debits you have going into/out the account. If they say its too late for a payment plan ask to speak to his or her superior. The person was just telling you that to see if they could get you to pay off the balance in full. At the end of the day they just want what you owe. They know no on has $8300 sitting around. Try again set up a payment plan and try to talk to someone in chrage.

rather than go bankrupt, if I were in your shoes I'd just get a second and maybe a third job, cut my food budget, don't buy anything, get rid of stuff I don't use and can sell, and I'd let them garnish my wages till it all was paid. I know people who can live on $10,000 a year, it IS possible.
