If I didn't file taxes but my girlfriend use my tax credit from school funding like loans and grant?


If I did'nt file taxes but my girlfriend use my tax credit from school funding like loans and grants and how do put this on my Fasfa but someone told me I don't have too b/c i didi'nt file taxes and thats not income but just tax credit so please help me b/.c I don't want to get in trouble but the tax preparer told me just don't worry b/c she is filing and I'm just being claim by her? Thanks

Loans to pay for school are not income to you, but they *do* count towards your total support.

Scholarships/fellowships/grants used to pay tuition don't count as income *or* support. If used for non-tuition purposes (room and board for example), they are fully taxable and do count as a support expense.

To claim you as a dependent, your total taxable income must be less than $3400 (you cannot have filed and claimed EIC), you must live with her all year and she must be able to prove that she, not you, provided more than half of your total support.

This is difficult to do. FASFA will verify the numbers and will tell your g/f to amend her return if she didn't qualify to claim you.

Any scholarships and grants that you receive are for YOUR use, not your girlfriends. If you don't use them for YOUR qualified educational costs the money becomes taxable income to YOU and YOU must list it as such on YOUR tax return.

Using the proceeds of an educational loan for any other purpose than YOUR qualified educational costs is Loan Fraud. That's a Federal felony if the lender is a Federally chartered institution.

Using any tuition credits or deductions that belong to YOU on someone else's tax return is Tax Fraud. That's about the only thing worse than Loan Fraud.

So, no, your girlfriend cannot use any of your educational benefits without at least creating a tax liability for you, or possibly committing a crime depending upon the circumstances.

Your FAFSA is signed under penalties of perjury just as your tax return is. Another Federal felony if it's not true and accurate. Stop listening to idiots telling you to try to get one over on the system. YOU will lose in the end. And get a new tax preparer; yours sounds dishonest.
