I gave my money to a real estate investor and he did not make his monthly payment.?


What can I do to get my $175k back if he is not paying his 16% interest this month?? I am really getting worried that his company is going to eventually shut down. Its called aab Incorporated (Alexander, Anthony & Brown Incorporated. I do have a note that this was a quarterly contract and basically its been a year to date his month. What are the procedures to get out of this deal???

With the housing market like it is now, it's most likely he probably got in some bad real estate investments and lost the money.

Go talk to a lawyer about how to recover your money. You are not going to get good legal advice on here.

Read your note. What provisions are written in the promissory note the investor signed and what are the terms.

I hope you had a lien filed with the county on the property you loaned $ on. If you did, and the investor has violated the contract, you have the right to foreclose. You need a real estate attorney to handle this for you. Do not try it alone.

Also, I hope you had the investor not only sign as owner of the company, but also personally. If so, you may go after the personal assets as well. Speak with an attorney on this as well.

You can not just get out of the deal, unless the borrower has violated the note, giving you the right to foreclose, or your note specifies you have the option of calling the note due in full upon specified written notice.

When making private investor mortgage loans, you should be very careful who you lend to, pay extreme attention to the financials of the asset you are lending on, and have a promissory note written up by an attorney to protect your interests.
