If a CD (certificate of deposit) has pay on death named benficiaries, is it still part of one's esate? |
A lawyer is executor of my will and entitled to a percentage of my assets. If some of these assets (Cds, Money Market Funds etc.) pass directly to beneficiaries I have chosen, does he still get a percentage as my executor? Your lawyer will get a percentage of all of those, unless otherwise specified in your agreement with your lawyer. I have seen situations before where a legal order is placed on those assets to pay whoever first before the beneficiaries are paid. Your assets will pay whatever cut your lawyer agreed to, and then your beneficiaries will get whatever is left. |
