I am starting an Online Business Selling Products, Its me and my Fiancee, what type of Business should it be?


I have to register my Business with the Local County Clerk's Office, and I am not sure whats the best thing to do in my situation. The Online Business is going to be run by me and my Fiancee, its just us two and no one else. Being that its more than one do we have to Register as a Corporation? Do both of our names have to be filled in on the Business Registration Form? Could we call it a Sole Proprietor Business and just put one of our names down? would that cause an issue?
If somebody knows what I should do or the best thing for me and My Fiancee to do please let me know...Any information would be highly appreciated.

Well my opinion is that there are two issues to consider here, the first is the type of corporation for legal purposes. If you do a sole proprietorship or partnership and you get sued, then everything you own personal or not could be taken to pay the suit. However, a sole proprietorship/ partnership will allow you to write off a bunch of tax expenses for your home whereas a corporation, you can't do that.

Second, you may want to do a partnership and quickly write up a contract explaining the business, who would do what and what each would get in the case that you two broke up. It's a terrible thing to think about, however you have to brace for that possiblity in the event that you're very successful in your venture.
