my parents are both on social security and my dad has also company pension they are thinking about filing bankrupt... can anyone of their loans take from their funds? they are both over 65 years of age I believe they cannot take either Social Security or funds from a pension. No-they can't garnish either of those things. If they have other assets, the creditors can go after them. You have to look at your state exemptions. |
