Checking acct frozen, I receive SSDI & a sm pension, only checks comming to this acct, how to remove?


My bank put a freeze on my checking acct from a debter, my SSDI & a sm pension is the only thing going to this acct, is SSDI & pension exempt? What do I need to do, to unfreeze? I was never served, the address where the sumons was served was not my address, I never had a chance to state my case, I live in St. Louis, MO. What can I do? I have no funds to pay my rent, this happen, 12/30/2006, I need to know what to do to unfreeze, the bank said that they have to follow the court order, PLEASE HELP

First you need to contact the attorney firm handling the freeze. You should have received a form to complete that states reasons why your funds are exempt from lien (SSDI). Apparently a judgement has been granted against you for non-payment of a debt and your bank account was frozen through a process called garnishment.

The bank is correct that they cannot "unfreeze" the funds. The court order that authorized the freeze must be dismissed or discharged before they can release the funds. If no dismissal or discharge is obtained then the frozen funds will be sent to the creditor who obtained the judgement.

Even worse, they can obtain another garnishment against your account and do this again and again so you need to take action on this IMMEDIATELY!

visit your bank first thing Jan 3rd and talk with a manager to fix it.

Get a copy of the court order and contact the court for an appeal. They shouldn't be able to take any funds from your account that were deposited from untaxed state/federal income. You didn't get a chance to appear in court to state this, so an appeal may be your only hope.

Make arrangements to have your check sent to your home. You will have to confront your problem though or it will follow you forever. I suggest you get in touch with legal aid asap. Good luck.

First contact social security to change your address on your check and have it come to your street address or a post office box. Try and do this before the 5th of the month. As far as the money they already took there is nothing you can do about it. Try and get some help from local churches to help with rent and food and utilites. Close out your bank account because if you don't they can always do it again.
