Private tenants rights re viewings!!!!? |
To cut a long story short, I am a private tenant who agreed with landlady that we could rent the house with view to buy - our contract states that - ' it has been agreed that between both parties that the property will be let until a time when the current occupiers (us) are in a position to purchase the property at full market value.' she knows we are not in a situation to buy at market value? She has told my cousin she will want to put the house up fpr sale in march to ensure it sells in time - and that they would give us 3 months notice (which is what is agreed in contract if either of us wants to finish it) so in that time do I have to let people in to view - afterall I am going to have a newborn baby + breastfeeding and my partner works shifts hence no privacy!! I want to know where I stand before she decides to tell me all this herelf, as she has not yet. Thanks. Yes,she is,see a solicitor because she is not allowed to keep putting your rent up either, there are laws in place for tenants regarding rent increases, plus you have a contract with your conditions, she hasn't got a leg to stand on. The clause allowing you purchase rights are a bit vague. What if you are never in that position? Its not her duty to provide you with a house. Any decent lawyer could tear it apart. It might be as well to move out. To be fair to her she has herself to think about, not your family. I expect the rises in rent is more to do with the rises in interest rates that have been high. What consideration has been exchanged here? Else, see The Office of the Deputy PM, long and short hold tenancies. Neither you nor your landlady should have signed a contract with no time limit on it. Once she realised you were pregnant, it dawned on her that she was lumbered with you for a very long time - no wonder she panicked and put the rent up. Was this contract drawn up by a solicitor ? Yours or hers ? Either way, go and see the solicitor and get a clarification of where each party stands. Sounds to me like you need to start looking for a new place to live. If this is not her primary home she will have to pay capital gains no matter what! |
