If I am in a partnership can I collect unemployment from another job I am losing?

should I close the business first? The business is a startup with limited capital and profit.

I am an active partner in the other business but it just hasn't taken off of the ground. The partnership I am in is with the my current employer, we started this other business to compliment the existing business. Not sure if this is a disqualifier or if I should sell him my portion (not worth very much) prior to applying for Unemployment.

If you lose your job and qualify for unemployment, having invested in a partnership should not prevent you from getting the benefits. You are not an employee of the partnership. However, if you are involved in running the partnership, that may disqualify you. the unemployment office should be able to decide if you qualify for benefits.

you have a job (your partnership) unless you do nothing
for the business, you can't claim unemployment.
