I am new at being a landlord so i have a question.?


my tenants are nasty. when i lved in the home it never had roaches and i mean bad roaches u see in day time. can I as a landlord evict tenant for being nasty and bring down the value of my investment?

I am a lanlord also. Many of my tenants are nasty as well. It is really hard to legally kick someone out of your house. I don't think that would be basis to kick them out, although you would like to. What you can do is make them sign a contract that lists the things that are and are not acceptable. If they sign it, it is a legal document. It is also helpful to take pictures of the home before you rent it to someone, and have them sign off on it saying that is what the house looked like when they got the keys to it. It is also helpful, and prevents a future headache if you just call their previous landlords, and make them fill out a rental application with a $20 dollar fee (to check their credit) this is usually a good way to see if the potential renters you have a worthy of your time and your home. If they don't cough up the initial fee, and the information, you don't want them anyway because chances are they are hiding something. You can purchase credit reports, backround checks and judgments from previous landlords online. It is a great investment (plus they pay for it) and can save you a lot of time and money in the long run.

Tenants are responsible for ensuring that they do not cause irreparable damage (other than normal wear and tear) to their unit. Being "nasty" will not necessarily bring down the value of your investment....it will just require a bit of cleaning :)

However, you do have the right, in most jurisdictions, to visit the apartment for routine repairs and inspection if you give the tenants 24 hours notice.

If they are so dirty that they have roaches, then chances are that they are also being careless in other ways, such as leaving puddles on floors that could cause permanent water damage, or having dangerous electrical hook-ups lying around. If this is the case, then you definitely have cause to consider evicting them, or at least charging them for damages. Check with your local housing authority to see what the rules are in your area.

Your question depends on the type of agreement you signed when your tenants moved into your rental.

If they are on a month to month rental, normally both you and the tenants can give each other 30 days notice and the contract is void, you do not need a reason.

What you should do is contact the local Apartment Association in your local area. It cost a few dollars to join and normal monthly membership dues, but it is well worth the time and money. Most have monthly meetings, the ability to run credit reports for it's member's tentants. They normally have monthly meetings to keep members abreast of new and local laws governing rentals and other things about the field. They also publish a monthly magazine for it's members that have current information concerning rentals. You should be able to find them in your local telephone book under Apartment House Association, Apartment Housing Association or just Apartment Association.

I think even the fee for joining and monthly dues are tax deductable. Check with your tax preparer for any tax advice.

The problem is how could you prove it was you tenant who caused the problem? If you cannot prove it was his fault, then you cannot legally evict him.

I think the best way to deal with the problem is to get a pest control company to get rid of the roaches. If the house has roaches again, you may have a solid case.

Remember, a good tenant is very hard to find. If you care about your tenant, he will care about you too.

You have a duty to exterminate properly.

It's easy to blame the tenants, but its not always the tenants fault.

If you are exterminating properly and they just won't do anything to help contain the problem, then you can take steps to evict them.
